CA.247 CORPORATE FINANCIAL MONITORING - APRIL 2012 TO JUNE 2012
Delegated decisions:

1. That the financial position of the Council as at 30 June 2012 be noted.

2. That approval be given to the s151 Officer’s assessment of the minimum level of balances.

Reasons for the decision:
The report has been prepared in accordance with all relevant Codes of Practice and provides early warnings of potential major overspends or underspends which members need to be aware of.

CA.248 PUBLIC HEALTH TRANSITION ACTION PLAN 2012 TO 2013

Delegated decisions:

1. That the report submitted be noted.

2. That the scope and content of the Public Health Transition Action Plan be adopted and signed off.

Reasons for the decision:
In November 2011, all primary care trusts were required to develop a comprehensive plan detailing actions to enable the safe transition of public health to the local authority by April 2013.

CA.249 COMPLAINTS POLICY
Delegated decision:

That approval be given to the implementation of the Adult Care Services Complaints Policy with effect from 1 September 2012.

Reasons for the decision:
Adult Social Care Complaints are required to follow a statutory process. This policy will assist in the effective and efficient handling of such complaints

CA.250 RADCLIFFE REGENERATION STRATEGY:REFURBISHMENT OF EMPTY PROPERTIES INTO PILOT PRODUCTIVE USE
Delegated decisions:

1. That approval be given to establish and deliver a pilot project to tackle local unemployment issues and private sector empty properties in Radcliffe.

2. That approval be given to spend £617,000 of accumulated Affordable Housing commuted sums (received in lieu of affordable housing provision on larger housing development sites) to part fund the Radcliffe empty property pilot, in line with housing and planning policies and the rules governing affordable housing and the use of commuted sums.

3. That approval be given to delegate authority to agree and approve relevant detailed matters to the Executive Director of Environment and Development and the Executive Director of Resources, in consultation with the Cabinet Member for Finance and Resources and the Cabinet Member for Neighbourhoods and Regeneration. The detailed matters to include how training and employment criteria will be incorporated into the pilot and how the commuted sums monies will be split across the registered providers, the financial appraisal per property and other relevant detailed agreements between the Council and the registered providers.

Reasons for the decision:
This decision will enable the delivery of a pilot which will address local unemployment issues and tackle the significant problem of private sector empty properties in Radcliffe. It will also make best use of available resources. The pilot project is expected to have significant outcomes and the experience gained will be used in future proposals in other areas of the Borough. Creating affordable housing through the project provides value for money in the use of the commuted sums monies which have no competing priorities.

CA.251 ANNUAL REPORT TO TENANTS 2011/12
Delegated decision:

That approval be given to the Annual Report to Tenants 2011/2012.

There is a requirement for all social landlords to produce the report on an annual basis.

CA.252 DRAFT LOCAL SCHEME OF COUNCIL TAX SUPPORT
Delegated decision:

That approval be given to the draft Council Tax Support scheme as a basis for consultation.

Reasons for the decision:
Proposed Government legislation will abolish Council Tax Benefit from April 2013 and replace it with powers for local authorities to design and run their own schemes.

CA.253 CONSULTATION ON PROPOSED REVISION TO THE POLICY ON ELIGIBILITY FOR HOME TO SCHOOL TRANSPORT

Delegated decisions:

1. That approval be given to consultation with stakeholders in respect of changes to the Council’s home to school transport policy.

2. That a further report be submitted to the Cabinet in December 2012 on the outcome of the consultation.

Reasons for the decision:
The current home to school transport policy goes beyond the statutory requirements in providing discretionary financial assistance to pupils attending denominational schools. The significant financial pressures faced by the Council mean that this level of financial assistance cannot be sustained.

Retain the existing school transport policy.

Questioner: Mrs Haydock
Question: Will the production of the Bury Core Strategy use information from the 2012 census?
Response: It is likely that the information will be taken from an earlier census. You will be contacted to confirm the census to be used.

Questioner: Councillor B Caserta
Question: The Cabinet is to consider a report on a Consultation on a proposed revision to the policy on eligibility for home to school transport. The Council met to consider the issue and a petition was handed in. Could I have the petition?
Response: Checks will be made on the submission of a petition.
CA.246A report was submitted by the Leader of the Council outlining the progress during quarter one 2012-2013 for the corporate performance indicators and projects within the Bury Council Corporate Plan. The information is extracted from the Performance Information Management System (PIMS) and provided by the responsible services.
CA.247The Cabinet Member for Finance and Resources submitted a report which provided information of the Council’s financial position for the period up to June 2012 and projected the likely outturn at the end of 2012/2013.

The report included details of Prudential Indicators in accordance with CIPFA’s Prudential Code.
CA.248The Cabinet Member for Adult Care, Health and Wellbeing submitted a report on the Public Health Transition Plan.

The Plan provided details on the current state of readiness, the action required and identified risks associated with the transition of the Bury public health function, programmes and services to the Local Authority, Bury Clinical Commissioning Group, the National Commissioning Board and Public Health England.

The programme of work and the associated action plan is overseen by the Public health Transition Programme Board which is chaired by the Executive Director of Adult Care Services.
CA.249The Cabinet Member for Adult Care, Health and Wellbeing submitted a report on a Social Care Complaints Policy for Adult Social Care. The policy is based on statutory guidance issued by the Department of Health and will provide guidance to the public and staff on the process used when a complaint relating to adult care services is received.
CA.250The Cabinet Member for Neighbourhoods and Regeneration submitted a report regarding a pilot project to provide training opportunities, address unemployment issues and tackle the problem of empty private sector properties in Radcliffe. The pilot project would be supported and part funded by £617,000 accumulated commuted sums from the Council’s Affordable Housing Planning Policy.

The pilot forms part of the Council’s overall Regeneration Strategy for the Borough and in particular the Regeneration Strategy for Radcliffe.
CA.251The Cabinet Member for Neighbourhoods and Regeneration submitted a report seeking approval for the publication of the Annual Report to Tenants 2011/2012. Production of the report has been delegated to the Arms Length Management Organisation (Six Town Housing).

The report sets out how Housing Management Services have performed during the last financial year providing an honest and challenging view of service performance. Information is also provided on how tenants have and can become involved in the development of the services they receive. The Annual Report was produced and designed in partnership with tenant representatives.

The report will be circulated to all tenants by October 2012.
CA.252The Cabinet Member for Finance and Resources submitted a report updating Members on the development of a Local Council Tax Support scheme within the available budget.
CA.253The Cabinet Member for Children and Families submitted a report setting out proposals to consult on revisions to the Council’s Home to School Transport Policy as it applies to all pupils, but with specific focus on changes to eligibility criteria in respect of attendance at denominational (faith) schools.

The purpose in bringing forward proposals is to enable funding pressures in relation to transport, as set out in the report submitted, to be addressed, and which would otherwise result in increasing demands on the Children’s Services budget, and to identify savings that can contribute to the significant budget pressures faced by the Council.
