P.562 PROPOSAL TO CONSTRUCT 26 WIND TURBINES ON SCOUT MOOR EDENFIELD
Delegated decision:

To support the proposed development as a contribution to the generation of renewable energy and a shift towards a low carbon society, with the premise that although the proposed development will have an impact on the visual amenity of the Borough this is not unacceptable.
P.563 APPLICATION TO CLOSE PART OF PUBLIC FOOTPATH NUMBER 38, TOTTINGTON AND CREATE PUBLIC FOOTPATH NUMBER 107, TOTTINGTON
Delegated decision:

That approval be given to the application to close part of footpath number 38, Tottington and the creation of Public Footpath Number 107 Tottington in order to allow development to take place and authorise the Council Solicitor to process the necessary orders and agreements.

P.567 APPLICATION TO REGISTER LAND KNOWN AS THE LODGES WALSHAW, BURY, AS A TOWN OR VILLAGE GREEN UNDER THE COMMONS REGISTRATION ACT 1965

That approval be given to instruct a barrister to sit alone as an inspector and hold an inquiry at the end of which a report would be submitted to the Planning Control Committee with a recommendation on how the application, based on the views of the inspector, should be determined.

P.558Members of the Committee were asked to consider whether they had an interest in any matters to be discussed at the meeting. None were declared
P.562A report of the Borough Planning and Economic Development Officer was submitted regarding an application by United Utilities Green Energy Ltd. and Peel Investments (North) Ltd. for the construction of a wind farm on Scout Moor Edenfield. Though not a statutory consultee Bury MBC could submit planning related comments on the application via Rossendale or Rochdale or direct to the Department of Trade and Industry (DTI).

The Committee were informed that all members of the Council had been invited to an officer presentation on the issue which had included input from United Utilities and objectors to the scheme. The Committee also heard representations for and against the proposal at the meeting.

The Borough Engineer submitted a report regarding an application to close part of a public footpath number 38, Tottington and the creation of Public Footpath Number 107, Tottington as detailed in plan number PRW/38/TOTT/DC/1.

P.565A report of the Borough Planning and Economic Development Officer was submitted describing the statistics relating to planning applications, and giving an assessment on how the service is performing in relation to national targets. The report included an action plan to improve performance on dealing with major and minor planning applications.
P.566A report of the Borough Planning and Economic Development Officer was submitted presenting a summary of the outcome of recent appeals and those appeals still awaiting a decision.
P.567A report of the Council Solicitor was submitted regarding an application requiring the Council to act as Registration Authority in order to register land as a town or village green under the Commons Registration Act 1965. The area of land involved is known locally as the ‘Lodges’.
