P.680 SITE VISIT

The extension to the barn, by reason of its height size and position would be severely detrimental to the visual amenity of both the nearby residents and the area in general as well as the openness and character of the Green Belt and would therefore conflict with Unitary Development Plan Policies OL4/5 - Agricultural Development, OL1/2 - New Buildings in the Green Belt, EN9/1 - Special Landscape Areas and OL7/2 - West Pennine Moors.

P.678There were no declarations made in respect of any of the items on the agenda.
P.681A report by the Chief Planning Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 52082, 52093 and 52147.

During the afternoon, prior to the meeting, the Committee undertook a site visit in respect of application number 52082.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.

The Council’s Legal Services representative referred to application 52093 and a letter received from Britannia Hotels. The letter stated that the correct legal position had not been clearly explained to the Committee in the Chief Planning Officer’s report. Britannia Hotels had inferred that this could mislead the Committee. The Committee was informed that the Council Solicitor was satisfied that the information in the Chief Planning Officer’s report was accurate and did not mislead members. It was confirmed that the Committee was being asked to determine the application upon the merits in the usual way based on planning policy and material planning considerations. The extant planning permission issue referred to in the letter from Britannia Hotels was a legal matter that would be determined by a court of law and should be discounted by the Committee.
P.682A report by the Chief Planning Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Chief Planning Officer were included.

The Committee was informed that application 51328 had been scheduled to be heard at a public enquiry and was subsequently withdrawn by the appellant a short time prior to the hearing date. The Planning Inspector had dismissed the appeal and awarded costs to the Council as a result of the appellant’s unreasonable behaviour.
P.683A report by the Chief Planning Officer was submitted, which listed recent Planning Application decisions made by Officers under delegated authority.

The Committee welcomed the report and requested that a regular report be submitted to keep elected members informed of planning decisions across the Borough.
