P.659 FUTUTRE SITE VISIT
Delegated decision:

1. That consideration of the following applications be deferred to the next scheduled meeting of this Committee on 24 March 2009: 50794 and 50795 Former Railway Goods Yard, Rowlands Road, Summerseat - North Manor Ward
Change of use from industrial to restaurant (Use Class A3)/ Listed Building Consent

2. That arrangements be made for the Committee to visit the above site for the reason that the impact of the proposed development on the surrounding areas is difficult to appreciate from photographs and drawings.

Approval is subject to the following additional condition:
Condition 18. The developer shall, with regard to television reception in the area containing the application site, provide the Local Planning Authority with studies that:
a) Measure the existing television signal reception within the potential impact area, (an area of 500 metres radius surrounding the building), before development commences. The work shall be undertaken either by an aerial installer registered with the Confederation of Aerial Industries or by a body approved by the Independent Television Commission, and shall include an assessment of the survey results obtained.
b) Assess the impact of the development on television signal reception within the potential impact area identified in (a) above within one month of the practical completion of the development or before the development is first occupied, whichever is the sooner, and at any other time during the construction of the development if requested in writing by the Local Planning Authority in response to identified television signal reception problems within the potential impact area. The study shall identify such measures necessary to maintain at least the pre-existing level and quality of signal reception identified in the survey carried out in (a) above. The measures identified must be carried out either before the building is first occupied or within one month of the study being submitted to the Local Planning Authority, whichever is the earlier.
Reason. To provide an indication of the area of television signal reception likely to be affected by the development to provide a basis on which to assess the extent to which the development during construction and once built, will affect television reception and to ensure that the development at least maintains the existing level and quality of television signal reception, as advised in Planning Policy Guidance Note 8: Telecommunications.

Variation of condition number 3 of planning permission reference 49415 for the redevelopment of a household waste recycling centre (HWRC), a transfer loading station (TLS) and a green waste processing facility (GWPF) to allow an extension of the permitted opening hours of the TLS and the GWFP. Delegated decision:

That approval be given to confirm the Tree Preservation Order 331, as detailed in the report submitted.
P.662 APPLICATION TO MAGISTRATES COURT TO CLOSE TWO PARTS OF PUBLIC FOOTPATH NUMBER 47, PRESTWICH
Delegated decision:

1. That approval be given to the making of an application to the Magistrates Court to close two parts of Public Footpath Number 47, Prestwich in order to remove two unnecessary lengths of path, which are shown on the Definitive Map and Statement as crossing the rear gardens of 32 properties.

2. That the Council Solicitor be authorised to make an application to the Magistrates Court.

Delegated decision:

That approval be given to the special considerations outlined in the report should be given some priority when determining Planning Applications for advertisements and banners within the area defined in the plan attached to this report.

Delegated decision:

P.6571. Councillor K Audin declared a personal and prejudicial interest in respect of application 50853 as a Board member of the Rivers Housing Association and left the meeting for period that the application was considered.

2. Councillor D Bigg declared a prejudicial interest in respect of application 50756 as a Council appointed representative to the Greater Manchester Waste Disposal Authority and left the meeting for period that the application was considered.

3. Councillor A J Cummings declared a prejudicial interest in respect of application 50756 as the Chair of the Greater Manchester Waste Disposal Authority and left the meeting for period that the application was considered.

4. Councillor M D’Albert declared a personal interest in respect of the proposed application to the Magistrates Court to close two parts of Public Footpath number 47 in Prestwich. The interest related to the Councillor’s involvement with local residents involved in promoting the closure of the footpath

5. Councillor D O’Hanlon declared a personal interest in respect of the proposed application to the Magistrates Court to close two parts of Public Footpath number 47 in Prestwich. The interest related to involvement in discussions with local residents regarding garden tenancies.

6. Councillor Y S Wright declared a prejudicial interest in respect of application 50756 as a Council appointed representative to the Greater Manchester Waste Disposal Authority. A further prejudicial interest was declared in respect of application 50804 for the reason that Councillor Wright holds a financial interest in a property near to where the site involved in located. Councillor Wright left the meeting for period that each application was considered.

7. Councillor A K Matthews declared a personal interest in respect of application 50853 as a member of the Rivers Housing Association Management Committee and remained in the meeting room during consideration of the application.
P.660A report by the Borough Planning, Engineering and Transportation Services Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 50667, 50724, 50756, 50779, 50794, 50795, 50796, 50804 and 50853.
The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.
P.661A report by the Council Landscape Architect was submitted relating to a proposal for a Tree Preservation Order 331 for an area located at Chesham Old Hall.
P.662A report by the Highway Network Services Manager was submitted relating to a proposal to make an application to the Magistrates Court to close two parts of Public Footpath Number 47, Prestwich.
P.663A report by the Assistant Director (Planning, Engineering and Transportation Services) was submitted relating to the forthcoming refurbishment and development works at the Rock in Bury Town Centre. The report recommends that where planning applications are submitted for advertisements and banners within this area, special consideration should be given to the current need to support businesses, to provide public information and to continue to communicate Bury Town Centre messages of ‘Business As Usual’ and ‘So Much More’.
P.664A report by the Assistant Director (Planning, Engineering and Transportation Services) was submitted, which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Borough Planning, Engineering and Transportation Services Officer, were also included.
P.665A report by the Council Landscape Architect was submitted relating to a proposal for a Tree Preservation Order 329 for an area located at 72/74 Church Street, Ainsworth, Bury.
