P.247 PLANNING APPLICATIONS
Delegated decisions:

1. That Approval be given to the following applications in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:-

52826 Sunny Bank, Arthur Lane, Ainsworth, Bolton, BL2 5PN - Radcliffe North Ward
Change of use of single storey domestic swimming pool to bungalow with single storey side extension

The decision to approve is subject to the following amendment:-

Condition 8. A sample panel of stonework and mortar for use within the extension and tower, demonstrating the colour, texture, face bond and pointing, of not less than 1 sq.m in size, shall be erected on site for inspection, and approval in writing, by the Local Planning Authority prior to the commencement of the development. Samples of the roofing materials and all other external materials shall also be made available for inspection on site. Thereafter the development shall be constructed in the approved materials and manner of construction.
Reason. In the interests of visual amenity and to ensure a satisfactory development pursuant to Policy EN1/2 - Townscape and Built Design of Bury Unitary Development Plan.

The decision to approve is subject to the following additional condition:-

Condition 7. Prior to the commencement of the development hereby approved, details of bins and their location shall be submitted to and approved in writing by the Local Planning Authority. The approved details shall be implemented in full prior to the car park being first brought into use.

P.248 APPLICATION TO MAGISTRATES COURT TO CLOSE PUBLIC FOOTPATH NUMBER 40, ST ANDREWS, RADCLIFFE AND PART OF PUBLIC FOOTPATH NUMBER 41, ST ANDREWS, RADCLIFFE
Delegated decision:

That the Committee authorise the Council Solicitor to make an application to the Magistrates Court to close Public Footpath Number 40, St Andrews, Radcliffe and part of Public Footpath Number 41, St Andrews, Radcliffe under Section 116 of the Highways Act 1980.

P.251 DEVELOPMENT OF GARDEN SITES FOR SEPARATE DWELLINGS

That the Committee acknowledge the recent changes in national Planning Policy (PPS3) and support the proposed approach for the Authority as detailed in the report.

P.245There were no declarations of interest made in respect of any items on the agenda.
P.247A report by the Chief Planning Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 52821, 52919 and 52944.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.

Prior to the meeting the Committee undertook a site visit in respect of planning application 52826.

P.248A report by the Temporary Chief Engineer was submitted seeking approval to an application to the Magistrates Court to close Public Footpath Number 40 , St Andrews, Radcliffe and part of Public Footpath Number 41, St Andrews, Radcliffe
P.249A report was submitted from the Development Manager detailing the contributions made by Section 106 Obligations in the past 3 years and summarising outstanding agreements.
Members welcomed the report and requested regular updates, including dates when agreements where made and further details as to the allocation of funds. Councillor Wright sought clarification on the timescales involved in relation to chasing payments for application no. 44581/50779.
P.250A report from the Development Manager was submitted describing the amendments set out to the regulations for the validation of planning applications. It was reported that the Government had issued a series of amendments and changes to planning regulations and had set out the policy on the information that must be provided in support of planning applications with the requirement for existing validation checklists to be reviewed and adopted by 31 December 2010. Members were informed that Bury’s local requirements needed to be reviewed and the report included a summary of the local Checklist criteria, incorporating the amendments.
P.251A report from the Assistant Director for Planning, Environment and Regulatory Services was submitted identifying recent changes in national Planning Policy (PPS3) in respect of domestic gardens including proposals on how this change could be applied locally.
P.252A report from the Development Manager was submitted providing statistical information on Enforcement Activity between 1 July 2010 and 30 September 2010, together with an update of Enforcement activity since the last report on 20 July 2010.
P.253A report by the Chief Planning Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Chief Planning Officer, were also included.

P.254A report from the Development Manager was submitted listing all recent Planning application decisions made by officers using delegated powers.
