Delegated decision:

That the Minutes of the Meeting held on 23 December 2008 be approved as a correct record and signed by the Chair.
P.594 PLANNING APPLICATIONS
Delegated decisions:

1. That Approval be given to the following applications in accordance with the reasons put forward by the Assistant Director (Planning, Engineering and Transportation Services) in the report and supplementary information submitted and subject to the conditions included:-

50748 Land adjacent to 68 Hardmans Road, Whitefield - Besses Ward
One 3 storey detached dwelling (resubmission)

50470 St Ann’s playing field, South Royd Street, Tottington - Tottington Ward
Installation of multi use games area, provision of a car park with vehicular access for use in connection with adjacent existing football pitch, changes to barrier at entrance to site, provision of pedestrian path to ballzone

50523 4 and 6 Arley Avenue, Bury - Moorside Ward
Change of use of 4 Arley Avenue from residential (Class C3) to school (Class D1) at ground floor (in conjunction with existing school at Arley Avenue with a maximum number of pupils rising from 28 to 38) and residential (Class C3) at first floor to provide a self contained flat
Approval is subject to the following additional condition:
Condition 7. Prior to the use hereby approved commencing a Travel Plan for the development (both 4 & 6 Arley Avenue) shall be submitted to and approved in writing by the Local Planning Authority. The Travel Plan shall then be implemented in accordance with the approved details upon the use commencing, unless agreed in writing by the Local Planning Authority.
Reason To minimise the impact of traffic pursuant to PPG13

50579 Land at Fir Street, Ramsbottom - Ramsbottom Ward
Two Storey building, providing 15 units of long term supported accommodation for people with learning disabilities, (3 units with 3 beds at ground floor, 6 separate units at first floor level) with 3 supervisor’s rooms

2. That application 50588 in respect of Toto Ristorante, High Street, Bury - Tottington Ward for the Redevelopment of existing restaurant and adjacent mill to form a wine bar and restaurant with first floor open car park accessed from Grassington Court, be refused for the reasons stated in the application.

3. That in respect of application 50769 relating to the land between 36 and 38 Seddon Avenue, Radcliffe - Radcliffe East Ward, for a Community Library, the Chief Planning Officer be given delegated authority to approve or refuse the application dependent upon the formal reply from the Environment Agency.

P.592No declarations of interest were made in relation to any items on the agenda.
P.594A report by the Borough Planning, Engineering and Transportation Services Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 50588, 50470, 50523 and 50769.

The Committee had undertaken a site visit prior to the meeting in respect of application 50588.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.
P.595A report by the Assistant Director (Planning, Engineering and Transportation Services) was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Borough Planning, Engineering and Transportation Services Officer, were also included.
