P.541 FUTURE SITE VISITS
Delegated decision:

1. That consideration of the following application be deferred to the next scheduled meeting of this Committee on 25 October 2005:

45002 Land at Victoria Court Tottington - Tottington Ward
Residential development - two semi-detached dwellings (resubmission)

2. That arrangements be made for the Committee to visit the above site for the reason that the impact of the proposed development on the surrounding area is difficult to appreciate from photographs and drawings.
P.542 PLANNING APPLICATIONS
Delegated decision:

1. That approval be given to the following applications in accordance with the reasons put forward by the Borough Planning and Economic Development Services Officer in the report and supplementary information submitted and subject to the conditions included:-

44720 Longsight Service Station, Longsight Road, Tottington - North Manor Ward
Redevelopment of existing petrol filling station.
Approval is subject to the following additional conditions:

Condition 10. No deliveries shall be made to any part of the site between the hours of 23:00 and 07:00 hours Monday night to Saturday morning or between 23:00 and 08:00 Saturday night and Sunday morning or between 22:00 and 08:00 Sunday and Bank Holiday nights and following morning.

Condition 11. Prior to the commencement of development on site, the applicant shall submit to the Local Planning Authority for their approval, a scheme detailing a vehicle barrier to the boundary wall on the western edge of the site. The barrier shall be provided prior to the development hereby approved first being occupied and shall thereafter be maintained for as long as the development remains in existence.

Condition 12. Within 28 days of the date of this permission, the applicant shall submit to the Local Planning Authority for their approval, a scheme for the security shutters around the shop hereby approved. The shutters shall be perforated and painted white and shall enclose the ATM, when closed down for the night. The shutters shall be provided and made available for use prior to the development and ATM hereby approved first being brought into use and shall thereafter be maintained for as long as the development remains in existence.

The approval is subject to the following additional conditions:

Condition 13. The dwelling at plot 6 hereby permitted shall be constructed in natural stone and slate and samples of the materials to be used in the external elevations shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced.

Condition 14. The existing retaining stone wall along the easterly and south-easterly boundary of plot 6 shall be maintained in perpetuity.

Condition 15. The development hereby permitted shall not commence until the vehicular access approved under previous planning permission reference 37921/01 has been constructed to the satisfaction of the Local Planning Authority.

2. That the Committee be minded to approve the following applications in
accordance with the reasons put forward by the Borough Planning and Economic
Development Services Officer in the report and supplementary information submitted and subject to the conditions included:-

45014 Land at Kay Gardens, Market Street, Bury - East Ward
Temporary siting of post office cabin for a period of 6 months.

The minded to approve decision is subject to:

- Delegated Authority being given to the Borough and Economic Development Services Officer to agree the detail of the scheme.

- An alteration to Condition 2 to read as follows:

That within 3 months of the first occupation and thereafter after each month, the applicant shall submit to the Planning Control Committee and the Executive a progress report in respect of the relocation of the Post Office to a permanent site within Bury Town Centre.
45007 Site of 229-257 Bury Road, Radcliffe - Radcliffe East Ward
Demolition of existing development; a residential development of 43 dwellings with proposed infrastructure upgrade and ancillary development (resubmission).

The decision is subject to a Section 106 Agreement for affordable housing, Art and Recreation Provision. If the Agreement is not signed by 28 October 2005 the application will be refused on the basis of none compliance with the Development Control Policy Notes 1, 4, and 5 UDP Policies RT2/2, EN1/6 and H4/1.

3. That approval be given to application 45109 Land at corner of Radcliffe New Road/Bury New Road, Whitefield - Pilkington Park Ward regarding the replacement of an existing 10 metre monopole with a 15 metre ultra slimline monopole incorporating 3 antenna.

4. That application 44979 Kingfisher Park Castle Road, Unsworth, Bury - Unsworth Ward for the change of use of an existing warehouse (Class B8) to plant hire depot and ancillary sales be refused for reason detailed in the report submitted.

5. That application 45101 32 Manchester Road, Bury - East Ward regarding the Conversion of a cellar to provide additional bedroom to flat one be refused for the following reason:

The proposed residential accommodation would give rise to an increased parking requirement rendering the proposed servicing and car parking provision inadequate. It would be likely to lead to vehicles parking and carrying out manoeuvres on the highway to the detriment of the free flow of traffic and road safety. The proposed development therefore conflicts with the following policy of the Bury Unitary Development Plan. H2/2 - The Layout of New Residential Development.

P.539Councillor W Flood declared a prejudicial interest in respect of planning application numbers 44907 and 44969 and left the room when the applications were consideration.

P.542A report of the Borough Planning and Economic Development Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers:
45014, 45101, 44720, 44968, 44752, 44907, 45007, 44980, 45002, 45121, 44996, 45012, 45109 and 44979.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to two minutes for each speaker.
P.543A report of the Executive Member for Environment and Transport was submitted informing the Committee of the background to Thornfield Properties Plc amended Rock Triangle Development Framework for Bury Town Centre.

The development principles had been discussed with the East and West Bury Area Boards respectively and other Bury Town Centre stakeholders ahead of the planning application stage. The report was submitted to the Executive on 21 September 2005.
P.544A report of the Borough Planning and Economic Development Services Officer was submitted regarding two proposed amendments to the boundary of the Town Centre Conservation Area. These would include within the proposed boundary the East Lancashire Railway Station, Castlecroft Goods Shed and parts of Bolton Street. The proposal would delete from the Conservation Area the site of the former Methodist Church and rear of the Post Office building off Crompton Street. The Committee had previously approved to the proposed boundary changes in April 2005 which was followed by a consultation exercise in the area during May involving interested groups.
P.545A report of the Borough Planning and Economic Development Services Officer was submitted presenting details of recent appeal decisions made by the Planning Inspectorate and recent appeals lodged against decisions of officers taken under delegated authority.
