1. That consideration of the following applications be deferred to the next scheduled meeting of this Committee on 14 September 2010:

Change of use of part of substation building to offices (Class B1); Raising of roof ridge height to create additional storey; Creation of access to 2 no. car parking spaces at rear (resubmission).

Partial demolition of single storey outbuilding and erection of new single storey extension to link to main house.

2. That arrangements be made for the Committee to visit the above sites for the reason that the impact of the proposed development on the surrounding areas is difficult to appreciate from photographs and drawings.

1. That Approval be given to the following applications in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:-

The decision to approve is subject to the following amendments:-

Condition 1. The development must be begun not later than twelve months beginning with the date of this permission.
Reason. Required to be imposed by Section 91 Town & Country Planning Act 1990.

Condition 3. Clean site won topsoil must be placed over the imported hardcore material to a minimum depth of 300mm within 12 months of the commencement of the development hereby approved. A validation letter report which includes a photographic record of the works to place the topsoil must be submitted to and approved in writing by the Local Planning Authority prior to the development being brought into use.
Reason. To secure the satisfactory development of the site in terms of human health and the wider environment and pursuant to Planning Policy Statement 23 - Planning and Pollution Control.

P.136 SITES OF BIOLOGICAL IMPORTANCE: 2008 REVIEW
Delegated decisions

1. That approval be given to adopt the updated Register of Sites of Biological Importance for planning purposes so that, in accordance with Planning Policy Statement 9, the Council’s decisions are based upon the most accurate and up to date ecological information;

2. That the officers involved in the Review be thanked for their continued hard work and commitment.
P.137 KIRKLEES VALLEY: DECLARATION OF LOCAL NATURE RESERVE

1. That the progress made towards the Council’s Local Nature Reserve declaration target be noted;

2. That approval be given to the declaration of the Kirklees Valley as a Local Nature Reserve and the Council Solicitor be authorised to proceed with the necessary orders;

3. That the officers involved in the progress made in relation to the Council’s Local Nature Reserve target be congratulated for their hard work and commitment.

P.132Councillor Hankey declared a personal interest in respect of Planning Application 52762, relating to Leigh Bank, 4 Glebelands Road, Prestwich for the reason that he is the Chair of the Bury Drug and Alcohol Abuse Partnership.
P.135A report by the Chief Planning Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers:

52416, 52762, 52783 and 52805.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.

Councillor V D’Albert spoke as a Ward representative in respect of application 52764. Councillor Walton spoke as a Ward representative in respect of application 52805.

Prior to the meeting the Committee undertook a site visit in respect of planning application 52697.
P.136A report by the Chief Planning Officer was submitted which identified recent changes made to the Register of Sites of Biological Importance in Bury. It also described the purpose and application of the Register.
P.137A report from the Chief Planning Officer was submitted in relation to the Council’s proposed declaration of the Kirklees Valley as a Local Nature Reserve. The report provided background information as to the Council’s Local Nature Reserve declaration target and how the declaration of the Kirklees Valley would take the Council close to its long-term Local Nature Reserve target.
P.138The Council Solicitor submitted a report detailing the Protocol on Decision Making for members of the Planning Control Committee and the subsequent amendments to the previous draft following informal discussion of the Protocol on 20 July, 2010 by members of the Committee.
P.139The Chief Planning Officer submitted a report providing a summary of the recent outcomes tour undertaken by members of the Planning Control Committee. Members felt that the tours were a valuable part of the Planning Committee process in terms of facilitating a review of a selection of outcomes from Planning Permissions that had been granted and as a training event on a range of planning issues. Members requested that a future tour include more ‘marginal’ developments.
P.140A report by the Chief Planning Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Chief Planning Officer, were also included.
P.141A report from the Chief Planning Officer was submitted listing all Planning application decisions made by Officers using delegated powers between 7 June, 2010 and 11 August, 2010.
P.142The Chief Planning Officer advised the meeting of a proposal to convene an additional meeting of the Planning Control Committee, on 23 September, 2010 in order to consider a planning application in respect of Red Bank House, Radcliffe, Manchester for the demolition of the existing Red Bank House care home and subsequent new development of a residential care home at this site. It was reported that the funding obtained for this development had been secured on condition of the application being considered by the Committee by 30 September, 2010.
