P.682 PLANNING APPLICATIONS

1. That Approval be given to the following applications in accordance with the reasons put forward by the Borough Planning, Engineering and Transportation Services Officer in the report and supplementary information submitted and subject to the conditions included:-

2. That the Committee be Minded to Approve the following application in accordance with the reasons put forward by the Borough Planning, Engineering and Transportation Services Officer in the report and supplementary information submitted and subject to the conditions included:

46702 Land at the Rock and Rochdale Road, (known as the Rock Triangle), Bury - Bury East Ward
Reserved matters application - mixed use development comprising shopping; food and drink within the A1, A2, A3, A4 and A5 Classes; 197 residential apartments (use Class C3); assembly and leisure uses within D2 use Class; multi storey and other car parking; new streets; highways and other means of access and circulation; and other associated works and facilities.
The decision includes a Section 106 Agreement concerning affordable housing.

3. That with regard to application 46702 Land at the Rock and Rochdale Road (known as the Rock Triangle), any proposal relating to cycling facilities within the pedestrian areas of the proposed development be decided by elected Members.

4. That application 46902 relating to Prestwich Pharmacy, 15 Fairfax Road - St Mary’s Ward, for a proposed change of use of the premises from a temporary pharmacy (A1) to D1 medical consulting rooms (temporary consent), be refused for the reasons detailed in the report submitted.

5. That application 46932 relating to 44 Rectory Lane, Prestwich - St Mary’s Ward, for a proposed change of use of the premises from a doctor’s surgery (Class D1) to a funeral parlour (Class A1) and single storey rear extension, be refused for the following reasons:

- The proposed use by reason of its commercial nature would be detrimental to the residential character of the area. As such the proposals would conflict with Policy EC4/1 - Small Businesses of the Bury Unitary Development Plan.

- The proposals would necessitate the potential use of the premises outside the normal working hours during the evenings and weekends, which would give rise to noise and disturbance to the detriment of the neighbouring residential properties. As such the proposals would conflict with Policy H3/1 - Assessing Non-Conforming Uses of the Bury Unitary Development Plan.

P.680Councillor M Connolly declared a prejudicial interest in respect of application 46702 and left the meeting room for the period that the application was considered.

Councillor W J Davison declared a prejudicial interest in respect of application 46902 and left the meeting room for the period that the application was considered.
P.682A report by the Borough Planning, Engineering and Transportation Services Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 46702, 46550, 46964, 46932, 47038, 46989 and 47059. The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to two minutes for each speaker.
P.683A report by the Borough Planning, Engineering and Transportation Services Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Borough Planning, Engineering and Transportation Services Officer, were also included.
