P.447 FUTURE SITE VISITS
Delegated decisions:

1. That consideration of the following applications be deferred to the next scheduled meeting of this Committee on 18 December 2007:

48578 Land off Dumers Lane and Morris Street, Radcliffe - Radcliffe East Ward
Outline for mixed use development consisting of 8500 square metres of employment floor space (Classes B1 and B8), 310 dwellings, a riverside park including associated land raising, creation of new accesses and landscaping.

48669 Butterstile County Primary School, School Grove, Prestwich - St Mary’s Ward
2 new classrooms on south elevation; Head-teacher’s courtyard; conversion of part of school to children’s centre with new entrance on west elevation

2. That arrangements be made for the Committee to visit the above site for the reason that the impact of the proposed development on the surrounding areas is difficult to appreciate from photographs and drawings.
P.448 PLANNING APPLICATIONS
Delegated decisions:

1. That Approval be given to the following applications in accordance with the reasons put forward by the Borough Planning, Engineering and Transportation Services Officer in the report and supplementary information submitted and subject to the conditions included:-

48290 Prestwich Heys FC, Sandgate Road, Whitefield - Holyrood Ward
Retention of changing rooms, store, toilets, clubhouse and fencing; installation of six floodlighting units including resurfacing and landscaping of car park.
Approval is subject to the following additional conditions:

Condition 16. This decision relates to drawings numbered C1369-P01, C1369-P02, C1369-P03, C1369-P04, C1369-P05, UKS4119 and, subject to condition 7, the development shall not be carried out except in accordance with the drawings hereby approved.
Reason. For the avoidance of doubt and to ensure a satisfactory standard of design pursuant to policies of the Bury Unitary Development Plan listed below.

Condition 17. Rear baffles shall be installed to the floodlights on the three units situated on the side of the football ground that is nearest to the houses in St. Joseph's Avenue.
Reason: In order to minimise any impact from spill light on nearby residential properties in accordance with Policy EN7 of the Bury Unitary Development Plan.

48519 Household Waste Recycling Centre, Cemetery Road, Radcliffe - Radcliffe East Ward
Redevelopment and extension of existing household waste recycling centre
Approval is subject to the following additional conditions:

Condition 20. No development shall take place until revised details of the site cabin have been submitted to and approved in writing by the Local Planning Authority. These details shall incorporate, as part of the facility, an access ramp and toilet facility suitable for use by mobility impaired persons. The site cabin shall not be constructed other than in accordance with the approved details.
Reason: In order to ensure the satisfactory use of the site cabin by the mobility impaired and those with special needs in compliance with Policy HT5/1 - Access for Those with Special Needs of the Bury Unitary Development Plan.

Condition 21. Prior to the commencement of the development a scheme for the suppression of noise from the activities on the site shall be submitted to and approved by the Local Planning Authority, the details of which shall be implemented prior to the first use of the development and maintained thereafter at all times the site is in operation.
Reason: To safeguard the amenities of the occupiers of nearby residential accommodation pursuant to Policies EC6/1 Assessing New Business, Industrial and Commercial Development, H3/1 Assessing Non-Conforming Uses, EN7/2 - Noise Pollution, MW4/1 - Assessing Waste Disposal Proposals and MW4/2 - Development Control Conditions (Waste) of the Bury Unitary Development Plan.

2. That the Committee be Minded to Approve the following applications in accordance with the reasons put forward by the Borough Planning, Engineering and Transportation Services Officer in the report and supplementary information submitted and subject to the conditions included:

48574 Land at Hutchinson Way/Hindle Street, Radcliffe - Radcliffe West Ward
Demolition of existing day nursery and two houses, construction of 70 apartments with semi-basement parking; construction of new day nursery with associated surface car parking (resubmission).

48659 St Ann’s House, North Street, Radcliffe - Radcliffe East Ward
Demolition of existing building and construction of 36 apartments with 43 car parking spaces (resubmission).

3. That application number 48722 relating to 8A-810 Bolton Road West, Ramsbottom - Ramsbottom Ward for a change of use of the first floor from retail (Class A1) to women’s fitness and weight loss centre (Class D2) including provision of access on elevation to Holt Street West be refused. The reason for the refusal of the application is as follows:

There is inadequate car parking for the proposed activity and this would give rise to on-street car parking to the detriment of the residential amenities of neighbouring occupiers contrary to policies H3 - Incompatible Uses in Residential Areas and HT2/4 - Car Parking and New Development of the Bury Unitary Development Plan.

4. That application number 48482 relating to Bankfield Mill, Pitt Street, Radcliffe - Radcliffe West Ward for a residential development of 18 dwellings be refused. The reason for the refusal of the application is a follows:

The plots numbered 10 and 11 would have an adverse impact on the residential amenities of existing dwellings by reason of their size, height, design and siting, contrary to the requirements of Policy H2/1 of the Bury Unitary Development Plan.
P.449 APPLICATION FOR MODIFICATION OF DEFINITIVE MAP AND STATEMENT, CONISTON CLOSE, RAMSBOTTOM
Delegated decisions:

1. That approval be given to the application for modification of the Definitive Map and Statement as supported by the evidence, which the Committee has determined sufficient that a right of way subsists or is reasonably alleged to subsist at Coniston Close, Ramsbottom.

2. That the Council Solicitor be authorised to make the necessary order to modify the Definitive Map and Statement.
P.450 APPLICATION TO DIVERT PART OF PUBLIC FOOTPATH NUMBER 96, RAMSBOTTOM
Delegated decisions:

1. That approval be given to divert part of Public Footpath Number 96 at Hazel Hall Farm, Summerseat to give the applicant use of an area of land unaffected by public rights of way and to ensure the Definitive Map and Statement record the actual location of the footpath.

2. That the Council Solicitor be authorised to make the necessary orders.

P.445(a) Councillors Y S Wright and P Ashworth both declared a prejudicial interest in respect of application number 48519, as member of the Greater Manchester Waste Disposal Authority and left the meeting room for the period that the application was considered.

(b) Councillor W J Davison declared a prejudicial interest in respect of application number 48290, as a trustee of the organisation concerned. Councillor Davison spoke to the Committee in his capacity as a Holyrood Ward representative (community advocacy) and left the meeting room prior to the vote being taken.

(c) Councillor S Cohen declared a prejudicial interest in respect of application 48477, as a friend of the applicant and left the meeting room for the period that the application was considered. Councillor YS Wright was appointed as the Chair in Councillor Cohen’s absence.

(d) Councillor O’Hanlon declared a prejudicial interest in respect of application 48669, as a Governor of Butterstile CP School. Councillor O’Hanlon spoke to the Committee in his capacity as a St Mary’s Ward representative (community advocacy) and the left the meeting room prior to the vote being taken.
P.448A report by the Borough Planning, Engineering and Transportation Services Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 48578, 48708, 48290, 48730, 48669, 48519, 48659, 48482, 48574, 48687, 48722, 48619 and 48477.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.

Prior to the meeting the Committee held a site visit in respect of application number 48290.

During the consideration of application 48669 the Chair directed the Commissionaire to remove a member of the public from the room for their unruly behaviour which was interfering with the proceedings.
P.449A report by the Highway Services Manager was submitted regarding an application made under Section 53 of the Wildlife and Countryside Act 1981 for modification of the Definitive Map and Statement by adding to it a footpath at Coniston Close, Ramsbottom.
P.450A report by the Highway Services Manager was submitted regarding an application by Stephen Hill of 1 Cinder Hill, Chesham, Bury, BL9 6ST to divert part of Public Footpath Number 96, Ramsbottom on behalf of Hazel Hall Farm, Summerseat.
P.451A report by the Borough Planning, Engineering and Transportation Services Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Borough Planning, Engineering and Transportation Services Officer, were also included.
