Delegated decision:

1. That Approval be given to the following applications in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:-

54621 Unit 1, Albert Close, Whitefield, Manchester - Whitefield & Unsworth - Besses Ward
Retrospective change of use of existing kitchen to general food sales (Use Class A5); Extractor unit to side elevation; External seating area; Proposed installation of solar panels to roof

The decision to approve is subject to the amendment of the following condition:-

Condition 5. The use hereby permitted shall not be open to customers outside the following times: 08.15 to 16:15 Monday to Friday. There shall be no Saturday or Sunday working and there shall be no direct means of
access/egress from the seating area and kitchen to Albert Close at any time.
Reason. To safeguard the amenities of the occupiers of nearby residential accommodation pursuant to Policy S2/6 Food and Drink of the Bury Unitary Development Plan.

The decision to approve is subject to the addition of the following condition:-

Condition 6. Notwithstanding the details indicated on the approved plans, the rear service entrance doors shall not open outwards onto the adopted highway.
Reason. To accord with the adopted Bury Unitary Development Plan Policy S2/6 - Food and Drink

2. That the Committee Refuse the following applications:-

54693 Junction of Manchester Road/Hollins Brow, Bury - Whitefield & Unsworth - Unsworth Ward
Junction Improvement Scheme which includes land to form widened highway together with assoiated works

The Committee debated a proposal not to accept the recommendation and to overturn the Officer recommendation of Approve with Conditions, for the following reason:-

1)The proposed scheme, as shown on the submitted plans, would be seriously detrimental to the residential amenities of 733 Manchester Road, by reason of the increased road traffic noise, loss of privacy and residential amenity as a result of bringing the highway closer to the main residential property and through insufficient boundary mitigation detailing. The proposed development therefore conflicts with the following policies of the Bury Unitary Development Plan: EN7/1 - Noise Pollution and HT4 - New Development.

This application was refused in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.
