P.268 PLANNING APPLICATION

1. That Approval be given to the following applications in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:-

1. Construction of a railway halt on the East Lancashire Railway with pedestrian/disabled access ramp, vehicular maintenance access ramp to track level with associated earthworks, lighting, CCTV system, fencing and landscaping.

Approval is subject to the deletion of conditions 3,5,6,10 and 11, as each relates to details for a proposed development and not an outline (principle) of the development. A correction was also made within the supplementary agenda with “Amended Condition 10” replaced by “Amended Condition 4.”

2. That the Committee be Minded to Approve the following application in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:

51247 Land adjacent to the Rock and St Johns Gardens, Bury (The Rock Development Scheme) - Bury East Ward
Amended scheme relating to block B (approved under 48384) for mixed use development comprising retail 6126 M2 retail floor space: 295 residential apartments (Class C3) associated servicing and access arrangements: amended elevations
The minded to approve decision is subject to the completion of a Section 106 Agreement relating to the provision of affordable housing in line with the already approved planning scheme 48384. Should the agreement not be signed within a reasonable time, the application be passed to the Chief Planning Officer to delegate the decision.
P.269 ST MARY’S CONSERVATION AREA (PRESTWICH) ARTICLE 4 DIRECTION
Delegated decisions:

1. That approval be given to confirm ‘The Metropolitan Borough of Bury St Mary’s Conservation Area (Prestwich) Article 4 Direction 2009’ under Article 4 (2) of the Town and Country Planning (General Permitted Development) Order 1995 in the form proposed.

2. That the Council Solicitor be authorised to sign the Direction accordingly.

P.265In the absence of Councillor B Vincent, Councillor S Cohen was appointed as Chairman of the meeting.
P.2661. Councillor M Hankey declared a prejudicial interest in respect of application numbered 51247 and 51465 for the reason that both applications fell within his remit as Executive Portfolio holder for Learning, Skills, Employment and Regeneration. Councillor Hankey left the meeting room during the consideration of each application.

2. Councillor O’Hanlon declared a prejudicial interest in respect of application number 51465 and the report relating to the St Mary’s Conservation Area (Prestwich) Article 4 Direction. Councillor O’Hanlon declared that he was the Chair of the Town Centre Regeneration Working Group, which had been involved in application 51465 and he was a member of the St Mary’s Conservation Group.
Councillor O’Hanlon addressed the Committee in respect of application 51465 in his role as a Ward Councillor for St Mary’s Ward and left the meeting room during the consideration of each report.

3. Councillor M D’Albert declared a prejudicial interest in respect of report relating to the St Mary’s Conservation Area (Prestwich) Article 4 Direction, as a member of the St Mary’s Conservation Group. Councillor D’Albert left the meeting room for the period the report was considered.
P.268A report by the Borough Planning, Engineering and Transportation Services Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 51274, 51368, 51465, 51577, 51578, 51603 and 51622.
Planning Control Committee 15 September 2009

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker. Councillor V D’Albert addressed the Committee as a Ward Councillor in respect of application 51622.

P.269A report by the Chief Planning Officer was submitted seeking approval to make a direction under Article 4 of the Town and Country Planning (General Permitted Development) Order 1995 in the from proposed to exclude permitted development rights for dwellings located within the St Mary’s Conservation Area of Prestwich.
P.270A report by the Chief Planning Officer was submitted, which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Chief Planning Officer, were also included.
P.271The Committee were informed that Councillor Vincent had been unable to attend the meeting due to illness and members sent their best wishes to him for a speedy recovery.
