P.547 PLANNING APPLICATIONS
Delegated decision:

1. That Approval be given to the following applications in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:-

The decision to approve is subject to the following amendment to Condition 8 and to the addition of Condition 12:-

Condition 8. Notwithstanding the submitted plans, a landscaping scheme, including details of the landscaping to the boundary with Cherry Trees, shall be submitted to, and approved in writing by, the Local Planning Authority prior to the commencement of the development. It shall be implemented not later than 12 months from the date the building(s) is first occupied; and any trees or shrubs removed, dying or becoming severely damaged or becoming severely diseased within five years of planting shall be replaced by trees or shrubs of a similar size or species to those originally required to be planted to the written satisfaction of the Local Planning Authority.
Reason. To secure the satisfactory development of the site and in the interests of visual amenity pursuant to Policy EN1/2 - Townscape and Built Design and EN8/2 Woodland and Tree Planting of the Bury Unitary Development Plan.

Condition 12. Notwithstanding the submitted plans, no development shall commence unless or until details of the external appearance of the proposed bin enclosure has been submitted to and approved in writing by the Local Planning Authority. The approved details shall be implemented in full before first occupation of the dwelling herby approved.
Reason. In the interests of visual amenity and to ensure a satisfactory development pursuant to the following Policies of the Bury Unitary Development Plan:

2. That the Committee be Minded to Approve the following application in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:

Conversion of groundfloor work units No.1 to 8 (Use Class B1) to 5 live/work units

3. That the Committee Refuse the following application:-

54712 87 Church Street, Ainsworth, Bolton - Radcliffe North Ward
Variation of Condition 2 - Approved Drawings - of 52380 - Replacement dwelling and access

The Committee debated a proposal not to accept the recommendation and to overturn the Officer recommendation of Approve with Conditions, for the following reasons:-

1. The proposed dwelling would, by reason of its height, massing, position and design, be a prominent and intrusive feature in the street scene and would therefore, be seriously detrimental to the visual amenities of the area. The proposed development therefore conflicts with the following policies of the Bury Unitary Development Plan:
EN1/2 - Townscape and Built Design
Ol1/2 - New Buildings in the Green Belt
H2/1 - The Form of New Residential Development

2. The proposed dwelling would be seriously detrimental to the residential amenities currently enjoyed by the occupier of the adjacent bungalow, by reason of its height, size and position. The proposed development therefore conflicts with the following policy of the Bury Unitary Development Plan:

P.548 DECISION MAKING ON APPLICATIONS TO DIVERT, EXTINGUISH OR CREATE PUBLIC RIGHTS OF WAY USING THE HIGHWAYS ACT 1980 OR THE TOWN AND COUNTRY PLANNING ACT 1990
That the Committee delegates its functions in respect of applications to divert, extinguish or create public rights of way, using sections 118 and 119 of the Highways Act 1980 and Section 257 of the Town and Country Planning Act 1990 to the Executive Director of Environment and Development Services or other appropriate Officers (save for where he/she/they does/do not wish to exercise such delegated powers to where any Member of the Council may request in writing that such applications should be determined by the Planning Control Committee.

P.544Councillor Harris declared a prejudicial interest in respect of planning application 54712, relating to 87 Church Street, Ainsworth, having been in contact with both the applicant and objectors prior to the Committee meeting.
P.547A report by the Chief Planning Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 54507, 54514, 54574, 54597, 54621, 54645, 54707 and 54712.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.

Councillor Tariq spoke as a ward representative in respect of application 54645.
P.548A report from the Service Manager - Traffic & Asset was submitted presenting a proposal to allow delegated decisions to be made by Officers with regard to applications to divert, extinguish or create public rights of way, mainly using sections 118 and 119 of the Highways Act 1980 and sections 257 Town and Country Planning Act 1990.

It was reported that, if approved by the Committee, the new arrangements would come into existence and any internal changes to working practice may be effected with the assistance of Democratic Services if necessary.
P.549The Development Manager submitted a report providing statistical information on Enforcement Activity between 1 October 2011 and 31 December 2011 together with an update of Enforcement Activity since the last update on 19 October 2011.
P.550A report by the Development Manager was submitted listing all recent Planning application decisions made by officers using delegated powers.
P.551A report by the Chief Planning Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Chief Planning Officer, were also included.
