That the Minutes of the meeting held on 20 November 2007 be approved as a correct record and signed by the Chair.
P.537 PLANNING APPLICATIONS
Delegated decisions:

1. That Approval be given to the following application in accordance with the reasons put forward by the Borough Planning, Engineering and Transportation Services Officer in the report and supplementary information submitted and subject to the conditions included:-

48669 Butterstile County Primary School, School Grove, Prestwich - St Mary’s Ward
2 New classrooms on south elevation; head-teachers courtyard; conversion of part of school to children’s centre with new entrance on west elevation

2. That the Committee be Minded to Approve the proposal in application 48799 Bury Ground, Castlecroft Road, Bury - Moorside Ward relating to the erection of a new divisional headquarters police station, including single and three storey buildings, car parking, landscaping and access onto new highways. The decision is subject to satisfactory resolution of issues relating to flooding and flood levels and in accordance with the reasons put forward by the Assistant Director (Planning, Engineering and Transportation Services) in the report and supplementary information submitted and subject to the conditions included. Delegated authority is also granted to the Assistant Director (Planning, Engineering and Transportation Services) to make a delegated decision on the scheme by 14 January 2008 to either grant permission, subject to satisfactory resolution of the flooding levels or refusal if agreement cannot be made with the Environment Agency:

3. That application 48806 relating to First Choice, Cook Street, Bury - Bury East Ward, regarding a mixed use development comprising Class B8 warehousing and 325 square metres of Class A1 food retail be refused for the reasons put forward by the Assistant Director (Planning, Engineering and Transportation Services) in the report and supplementary information.

4. That application 48578 relating to Land off Dumers Lane and Morris Street, Radcliffe - Radcliffe East Ward, regarding an outline application for a mixed use development consisting of 8500 square metres of employment floor space (Classes B1 and B8); 319 dwellings and riverside park including associated land raising, creation of new accesses and landscaping be refused for the reasons put forward by the Assistant Director (Planning, Engineering and Transportation Services) detailed in the report.

P.535(a) Councillor D O’Hanlon declared a personal and prejudicial interest in respect of application 48669, as a Governor of Butterstile CP Primary School. Councillor O’Hanlon spoke to the Committee in his capacity as a St Mary’s Ward representative (community advocacy) and the left the meeting room prior to the vote being taken.

(b) Councillor P H Redstone declared a prejudicial interest in respect of application 48578 and left the meeting room for the period that the application was considered.

(c) Councillor Connolly indicated that he would not take part in the vote relating to application 48806 due to lobbying by the applicant and work he had undertaken in facilitating meetings involving the applicant.
P.537A report by the Borough Planning, Engineering and Transportation Services Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 48806, 48799 and 48578.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.

During consideration of application 48669 the Chair directed the Commissionaire to remove two members of the public from the room for their unruly behaviour, which was interfering with the proceedings.
