p.117Councillor Wright declared a personal interest in respect of planning application 53922, relating to Woolfold Gap Recreational Route, Brandle Ave, Bury, for the reason that Cllr Wright had attended meetings of the ‘Friends of Kirklees’ Support Group when discussions in relation to the project linked to this planning application had taken place. Councillor Wright had not expressed an opinion in relation to this application at any of these meetings.

Councillor Smith declared a prejudicial interest in respect of planning application 53922, relating to Woolfold Gap Recreational Route, Brandle Ave, Bury, for the reason that the areas described within this application are managed by the Council Estates Department and Cllr Smith has responsibility for this particular Council Department as the Executive Member for Finance.
p.120A report by the Chief Planning Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 53800, 53864, 53922, 53955, 54006 and 54021.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.
p.121A report from the Assistant Director (Planning, Environmental & Regulatory Services) was submitted detailing the approaches the Planning, Environment & Regulatory Services Division currently takes to address empty private sector residential properties that are having a detrimental effect on the Borough’s environment.
p.122A report by the Assistant Director (Planning, Environmental & Regulatory Services) was submitted providing statistical information on Enforcement Activity between 1 April 2011 and 30 June 2011 together with an update on Enforcement Activity since the last update on 19 April 2011.
p.123A report from the Development Manager on Planning Enforcement, presented to the Internal Scrutiny Committee at a meeting held on 16 June 2011, was submitted, for information. The report set out the Council’s general approach to planning enforcement, including the primary responsibility of Local Planning Authority (LPA) in the matter and the decisive issue of whether a breach of planning control would unacceptably affect public amenity or the existing use of land and buildings meriting protection in the public interest.

The report also set out the legal framework in respect of planning enforcement and provided information on the different types of actions available to the LPA to remedy breaches of planning control.
With regard to local enforcement actions and performance the report included detailed statistical information on enforcement including a comparative analysis over the last 5 years. Further information providing comparative enforcement action information nationally was appended to the report.
p.124A report by the Development Manager was submitted listing all recent Planning application decisions made by officers using delegated powers.
p.125A report by the Chief Planning Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Chief Planning Officer, were also included.
