P.715 SITE VISIT
Delegated decisions:

1. That consideration of the following applications be deferred to the next scheduled meeting of this Committee on 25 May 2010:

52136 JLT House, Brook Street, Radcliffe - Radcliffe East Ward
Outline planning application for the erection of 20 two/three-storey houses in four blocks and a four-storey block of 10 apartments

52226 Park Farm, 206 Manchester Road, Ramsbottom, Bury - Ramsbottom Ward
Retrospective application for the retention of hardstanding to the rear of Park Farm Garden Centre

2. That arrangements be made for the Committee to visit the above sites for the reason that the impact of the proposed development on the surrounding areas is difficult to appreciate from photographs and drawings.
P.716 PLANNING APPLICATIONS

1. That Approval be given to the following applications in accordance with the reasons put forward by the Chief Planning Officer in the report and supplementary information submitted and subject to the conditions included:-

Variation of Condition 10 of planning permission 50535 to be amended to:
“The infilling works shall be completed within a period of 12 months from 24 August 2009”.

Change of use of first floor on number 34 from retail (Class A1) to restaurant/café (Class A3) incorporating existing restaurant/café at number 36

52324 Elton Garage, Bolton Road, Bury - Church Ward

2. That planning application 52224 relating to Black Moss Farm, Bolton Road, Radcliffe, Bury - Radcliffe West Ward, for the demolition of storage/workshop buildings, erection of block of 7 terraced houses and associated parking area be refused for the following reasons:-

1) The proposals would constitute inappropriate development within the Green Belt and the development would adversely affect the openness and character of the Green Belt. Therefore, the proposal would conflict with Policy OL1/2 - New Buildings in the Green Belt of the Bury Unitary Development Plan and PPG2 - Green Belts.

2) The traffic created by the development would be detrimental to highway safety in relation to Bolton Road. As such the development would conflict with Policy H2/2 - The Layout of New Residential Development of the Bury Unitary Development Plan.

(Councillor Cohen voted against the reasons to refuse planning application 52224).
P.717 APPLICATION TO DIVERT PART OF PUBLIC FOOTPATH NUMBER 158, BURY
Delegated decisions:

1. That approval be given to divert part of Public Footpath Number 158, Bury to allow a railway halt, for which planning permission has been granted, to be constructed.

2. That the Council Solicitor be instructed to make the necessary orders.
P.718 LAND BOUNDED BY FOUNDARY STREET/LORD STREET/SOUTH CROSS STREET BURY

Delegated decisions:

1. That approval be given to accept the amended employment contribution proposed, subject to the completion of a deed of variation to the original planning Section 106 agreement.

2. That approval be given to permit the sale of toys from the site.

3. That delegated authority be given to the Chief Planning Officer to determine any application relating to the variance of condition 15 that restricts the development of the site from 5 units changing to 3 units.

P.713There were no declarations of interest made in respect of any of the items on the agenda.
P.716A report by the Chief Planning Officer was submitted in relation to various applications for planning permission. Supplementary information was also submitted in respect of application numbers: 52136, 52224, 52324 and 52343.

The Committee heard representations from applicants and/or objectors in respect of the applications submitted. This was limited to three minutes for each speaker.

During consideration of planning application 52224, the Chairman adjourned the meeting for five minutes to allow legal advice to be given to the Committee in private.
P.717A report by the Temporary Chief Engineer was submitted regarding an application by Planning Services to divert part of Public Footpath Number 158, Bury, to allow the construction of a railway halt on the East Lancashire Railway.
P.718A report by the Chief Planning Officer was submitted seeking approval for:

a) The variance of condition 13 to allow the sale of ‘toys’ from the site; and
b) To consider providing delegated authority to the Chief Planning Officer to determine any application for the variance of Condition 15 that which restricts the site to the development of 5 units to 3.
P.719A report by the Chief Planning Officer was submitted providing a brief analysis of performance within Development Control for the year 2009/2010 with comparisons from previous years.
P.720A report Chief Planning Officer was submitted providing statistical information on Enforcement Activity between 1 April 2009 and 31 March 2010, together with an update on Enforcement activity since the previous report submitted on 20 January 2010.
P.721A report by Chief Planning Officer was submitted detailing information on performance in respect of planning appeals in 2009/2010.

Members requested that future training for Planning Control Committee members should include reasons for the refusal or approval of planning applications where the Committee’s decision is in opposition to the recommendation of the Chief Planning Officer.
P.722A report by the Chief Planning Officer was submitted which presented a summary of recent decisions made by the Planning Inspectorate. Details of recent appeals lodged against delegated decisions of the Committee and the Chief Planning Officer, were also included.
P.723A report of the Chief Planning Officer was submitted listing all recent Planning application decisions made by officers using delegated powers.
