Minutes:

The Panel met to consider an application pursuant to section 51 of the Licensing Act 2003, for a review of the premises licence issued by Bury Licensing Service, in respect of Cuckoo, 395-397 Bury New Road, Prestwich, Manchester.

 

Prior to presentation of the report and the Application, Mr Lyons, the legal representative of the licence holder addressed the Panel to raise a preliminary point that the Review Applicant had not complied with the relevant legislation, with particular reference to the serving of papers in accordance with Sections 51 & 52 of the Licensing Act 2003.

 

 

The Chair, Councillor Jones, informed those present that the Panel would adjourn to consider the points raised by Mr Lyons.                                                  

 

Delegated decision:

 

That upon consideration of all relevant representations and the provisions of the Licensing Act 2003 (‘the Act’) and Regulations made under the Act and having considered the advice provided by the Legal Officer, the Panel unanimously decided that the relevant requirements of the Act and Regulations had not been complied with in relation to the Review Application and therefore that the Review Application could not be determined and the Hearing would not proceed.
