Members of the Council are requested to declare any interests which they have in any items or issues before the Council for determination.

                    1. Councillor Connolly declared a personal interest in any item which related to staffing as his partner is an employee of Bury Council.

                    2. Councillor Jones declared a personal interest in any item which related to staffing as his wife is an employee of Bury Council.

                    3. Councillor Bevan declared a personal interest in any item which related to staffing as his wife is an employee within a Bury School.

                    4. Councillor Mallon declared a personal interest in any item relation to staffing as his partner is an employee within a Bury High School.

                    5. Councillor Walton declared a disclosable pecuniary interest in Minute C.383, Question on the work of the Greater Manchester Pension Authority, and left the meeting during consideration of this item.

To approve as a correct record the Minutes of the meeting of the Council held on 10 September 2014

          RESOLVED:

            That the minutes of the Meeting of the Council held on 10 September 2014 be signed by the Mayor as a true and correct record. 

To receive communications from the Mayor and any announcements by the Leader of the Council or the Chief Executive on matters of interest to the Council.

            The Mayor reminded Members of the forthcoming Remembrance Sunday Service on 9 November 2014 and the forthcoming Civic Ball on 6 December 2014.

To answer questions from members of the public, notice of which has been given, on any matter relevant to the Council or its services to the community.  Up to 30 minutes will be set aside for this purpose.  If time permits, further questions will be invited from members of the public present.

            The Mayor reported that there no written questions had been submitted. On inviting questions from members of the public present, the following issues were raised:-

(1)Minute LSP.350 of the Licensing and Safety Panel held on 6 October 2014 – Amendment to Scheme of Delegation to Licensing and Safety Panel.

                    It was moved by Councillor Jones and seconded by Councillor Walmsley and it was:-

                       RESOLVED:

That changes to the Council Constitution, as set out in the report, and which relates to the determination of public/private hire licences and policy issues within the Licensing Act 2003 and the Gambling Act 2005, be approved.

                    (2) Minute LSP.349 of the Licensing and Safety Panel held on 6 October 2014 – Delegation to Licensing and Safety Panel with regard to Council School and College Contracts.

                        It was moved by Councillor Jones and seconded by Councillor Walmsley and it was:-

                       Resolved:

                    That a delegation to the Licensing and Safety Panel to undertake reviews of drivers working on Council School and College Contracts, be approved.

          To receive a Statement from the Leader of the Council on the work of the Cabinet and to answer written questions from Members of the Council to the Leader and Cabinet Members on any matter in relation to which the Council has powers or duties which affect the Borough, provided the necessary written notice has been given.

          Verbal questions on the work of the Cabinet since the last Council meeting will be allowed subject to a limit of one question per Councillor.

(a) Written questions (Notice given)

                    The Leader of the Council, Councillor Connolly, made a statement on the work undertaken by him since the date of the last Council meeting.  The Leader and the relevant Cabinet Members answered questions raised by Councillors on the following issues:

            Due to the lack of time to answer questions 13 and 16 to 25 inclusive, the Leader gave an undertaking that copies of those questions will be circulated to all Councillors.  The Leader also gave an undertaking to make these available on the Council Web Site.

                       (b) Oral questions on the work of the Cabinet since the last Council meeting (without Notice)

                   (A)     A report by the Council’s Representative on the work of the                Greater Manchester Fire and Rescue Authority, Councillor                     Matthews.

(B)     Questions (if any) on the work of the Joint Authorities to be asked     by Members of the Council for which the necessary notice has been   given in accordance with Council Procedure Rule 11.2.

(a) Councillor Matthews, the Council’s representative, on the Greater Manchester Waste Disposal Authority, gave a verbal report on the work of the Authority to all Members of the Council.

                    (b) The following question had been received in accordance with Council Procedure Rule 11.2.

            A report of the Cabinet Member for Children and Young People was submitted which presented for consideration Bury’s Promise to Children and Young People in Care.

            It was moved by Councillor Campbell and seconded by Councillor Heneghan and it was:

              Resolved:

            That Bury’s Promise to Children and Young People in Care, as agreed by the Corporate Parenting Board, be endorsed.

Report attached

            A report of the Assistant Director – Legal and Democratic Services was submitted which sought amendments to the Council Constitution to reflect provisions which came into force on 6 August 2015 under the Openness of Local Government Bodies Regulations 2014.  Specifically, the Regulations state that whilst a meeting of a local authority is open to the public any person attending is permitted to report on the meeting, and should be afforded reasonable facilities for doing so.

            It was moved by Councillor Connolly and seconded by Councillor Shori and it was:-

              Resolved:

            That the Assistant Director – Legal and Democratic Services be delegated approval to amend the Council Constitution and Council Procedure Rules to reflect the provisions set out in the report

The following Notice of Motions have been received:- 

1. Waste Collection and Recycling

In view of the number of petitions and other forms of protest submitted by members of the general public  relating to the policy decision to collect the residual bins from domestic properties within Bury on a three weekly basis, this Council resolves to refer this decision back to the Cabinet Member for         reconsideration.

This Council recognises there are many other ways of collecting waste which will achieve the required level of recycling in Bury by 2016.

2. Fostering

This Council celebrates the achievements we have made, regarding the increase of in house foster carers, as we recognise that this brings better outcomes for our children and is more cost effective. Unfortunately, demand is still high and we need to use this council meeting to raise and discuss this issue and to ask this council as corporate parents to promote fostering within all avenues.  From this debate there will also be a full all members briefing. I urge this council to debate this motion in full, supporting the council in its endeavours.

            It was moved by Councillor Gunther and seconded by Councillor Gartside:

            There were no Scrutiny Review Reports or specific items “called in” by the Overview and Scrutiny Committee to be considered at this Council meeting.

          Questions on the work of outside bodies or partnerships on which the Council is represented to be asked by Members of the Council (if any).

            The following question had been received in accordance with Council Procedure Rule 11.2.

          Questions on the delegated decisions made by the Regulatory Committees and Scrutiny Committees contained in the Digest of Decisions 2 (2014/15) published since the last ordinary meeting of the Council, providing four clear working days’ notice has been given of the question.
